GENERAL TERMS OF USE OF WWW.KENSOL.EU – THE E-COMMERCE SITE OF “KENSOL TRADING” Ltd.
The WWW.KENSOL.EU site offers the possibility to purchase the presented products, as they are delivered directly to the customer at the address specified by him. Each user is bound by the rules of these general conditions of use from the initial entry to the site until leaving it.
I.General Terms
1.1.This document contains the General Terms and Conditions according to which “KENSOL Trading” Ltd. provides goods to its users/customers through the Internet store WWW.KENSOL.EU. These terms are binding on all users.
By pressing the ORDER button, the user/client agrees, fully accepts, and undertakes to comply with these General Terms and Conditions.
1.2. Identification of the user/client for the purpose of reproducing his/her statement of both acceptance of the General Terms and Conditions and of the order placed is carried out through the log files stored on the WWW.KENSOL.EU server, storage of the IP address of the user/client, as well as any other information.
1.3. After clicking the “ORDER” button, the user agrees to purchase the goods in his basket. This action is legally binding. The customer receives confirmation of the order and upon receipt of this confirmation, the contract is deemed to be concluded. Confirmation is received by e-mail or by phone call.
1.4. “KENSOL Trading” Ltd. reserves the right to refuse delivery of an order placed if the goods are not available. If there is no stock of the requested product, within the working week “KENSOL Trading” Ltd. notifies the user/client of its depletion by sending a message to the e-mail address specified by the Client or to the specified telephone number.
1.5. The contract language is English, and payments will be made in EURO.
II. OFFERED GOODS
2.1. The goods offered on WWW.KENSOL.EU are manufactured by “KENSOL” Ltd. It bears her trademark KENSOL.
2.2. Each model has its own article number, which is announced next to the photo of the model.
2.3. The model is offered as pictured (unless otherwise explained in text). “KENSOL Trading” Ltd. is not responsible for how the customer’s monitor is set and how he sees the color as a result.
2.4. Each item has a separate price.
If the customer wants to combine a top with pants or a skirt, he should order both parts separately.
2.5. The articles are sized according to the accepted European numbering. Letter numbering is used for knitted items.
III. Delivery
3.1. The delivery of orders made through the WWW.KENSOL.EU online store is carried out by chosen courier company. All shipments have a different delivery time depending on the receiving destination and the conditions of the respective courier service.
3.2. Immediately after handing over the goods to the courier, “KENSOL Trading” Ltd. is released from the risk of damage/loss of the goods before delivery, which is transferred to the user/customer. Every shipment sent by “KENSOL Trading” Ltd. has the mandatory insurance against damage/loss.
“KENSOL Trading” Ltd. is not responsible for any delay if the event that the delay is due to a courier or other supplier.
3.2. Immediately after delivery, the goods should be carefully inspected by the user/customer, or a person authorized by him. Any damage should be reported immediately to “KENSOL Trading” Ltd. If it is found damage occurred during the transportation of the goods, “KENSOL Trading” Ltd. is not responsible for the damage to these goods. If an incorrect address, contact person and/or phone number are specified when submitting the order, “KENSOL Trading” Ltd. is not bound by any obligation to fulfill the order.
3.2.1. When handing over the goods, the user/client or a third-party signs the accompanying documents. Anyone who is not the holder of the application but accepts the goods for delivery and is at the address indicated by the customer, is considered a third party. In case of refusal to receive the goods, except in the cases described below, the refusal is considered unfounded, and the Customer must pay the costs of delivery and return of the goods.
If the Customer is not found within the deadline for delivery to the specified address or access and conditions for delivery of the goods are not provided within this deadline, “KENSOL Trading” Ltd. is released from its obligation to deliver the goods requested for purchase.
3.2.2. When the delivered goods clearly do not correspond to the goods requested for purchase by the customer and this can be established by a simple inspection, the customer may request that the delivered goods be replaced with goods corresponding to the purchase request made by him within 24 hours of receipt. If goods are not available, Kensol Trading Ltd. Will return the paid amount.
3.3. Orders are processed within 5 working days.
IV. PRICES AND METHODS OF PAYMENT
The prices indicated on the website WWW.KENSOL.EU do not include transport costs.
Kensol Trading Ltd. works with different courier companies for different countries of delivery depending on best price. The delivery is free for client for all orders. Bank cards which can we used for paying are Visa, Visa electron, Master Card and Maestro. If the card is rejected, it is proper for the customer to check whether all the data have been entered correctly, whether the validity of the card has not expired, whether the limit for shopping by the bank itself has not been exceeded and whether the 3D authorization, which some cards require, has been done correctly. Security when paying with a bank card is guaranteed because SSL encryption is used for data transmission.
PayPal payments are accepted too.
Only SET transactions (Secure Electronic Transactions) are accepted for Visa and Mastercard payments. After verifying that the card is included in the SET system, the system contacts the card issuing bank to authorize the buyer to make the purchase. When the bank confirms the authenticity, the amount will be deducted from the card. Otherwise, the order will be cancelled.
V. RIGHT OF REFUSAL OF PURCHASED GOODS
The customer has the right, without owing compensation and without stating a reason, to withdraw from the concluded contract within 14 days from the date of receipt of the goods.
After exercising the right of refusal, the latter is obliged to return the received goods in their entirety, in the same form as they were delivered, with intact packaging, suitable for subsequent sale to other customers, together with all accompanying documentation. Provided that these requirements are met, “KENSOL Trading” Ltd. undertakes to refund the amount paid by the client.
The refund of the amount upon return of the goods is made to the bank card which was paid from within 14 working days from the date of receipt of the returned shipment.
The customer does not owe transport costs for returning the delivered goods to the company.
VI. OUT-OF-JUDICIAL WAYS OF ADDRESSING COMPLAINTS AND CLAIMS AND ACCESS TO THESE PROCEDURES
6.1. The use of out-of-court methods for the consideration of complaints and claims is voluntary. The texts below are informative in nature and do not oblige “KENSOL Trading” Ltd. to use extrajudicial methods to resolve disputes.
6.2. The user/customer has the following exemplary possibilities to use extrajudicial ways of handling complaints and claims:
а. The customer has the right to appeal to an arbitration court, with a claim to resolve the dispute arising from the concluded Purchase – Sale Agreement.
в. The customer can file a complaint through the Online Dispute Resolution Platform (ODR): http://ec.europa.eu/consumers/odr/. The Online Dispute Resolution (ODR) platform is also a source of information on ways of out-of-court resolution of disputes that may arise between Merchants and Users.
VII. USER/CUSTOMER RIGHTS AND OBLIGATIONS
7.1. The user/client can view and order the advertised goods on the Internet store WWW.KENSOL.EU
7.2. The user/customer has the right to be informed about the status of his order.
7.3. The user is obliged to pay the price of his order according to the methods announced on the page WWW.KENSOL.EU.
7.4. Every user, regardless of whether he is a client of “KENSOL Trading” Ltd., undertakes when using the services:
• not to violate and respect the fundamental rights and freedoms of citizens and human rights, according to the recognized international acts;
• not to harm the good name of another and not call for the commission of a crime, violence against the person or incitement of racial, national, ethnic or religious enmity;
• not to violate others’ property or non-property, absolute or relative rights and interests, such as property rights, intellectual property rights, etc.;
• to comply with applicable foreign laws, the rules of morality and good manners and Internet ethics when using the WWW.KENSOL.EU Internet store.
• to immediately notify “KENSOL Trading” Ltd. of any case of committed or discovered violation when using the provided services;
• not to upload, send, transmit, distribute or use in any way and not to make available to third parties software, computer programs, files, applications or other materials containing computer viruses, unauthorized remote control systems (“Trojan horses”), computer codes, or materials designed to interrupt, hinder, disrupt or limit the normal operation of computer hardware or software or telecommunications facilities, or aimed at unauthorized penetration or access to foreign resources or software;
• not to commit malicious acts;
• to indemnify “KENSOL Trading” Ltd. and all third parties for all damages suffered and lost benefits, including for any costs and attorney’s fees paid, incurred as a result of claims made by and/or compensation paid to third parties in connection with Internet pages, hyper- links, materials or information that the User has used, placed on the server, sent, distributed, disclosed to third parties or made available through WWW.KENSOL.EU in violation of the law, these General Terms and Conditions, Good manners or Internet ethics;
7.5. The customer undertakes to provide an accurate and valid telephone, delivery address and e-mail address, to pay the price of the goods, to pay the costs of delivery when the same is not free, and to ensure access and possibility to receive the goods. If it is not explicitly stated that the delivery is free, it is considered paid.
VIII. RIGHTS AND OBLIGATIONS OF THE MERCHANT
8.1. “KENSOL Trading” Ltd. does not have the obligation and objective ability to control the way users use the services provided.
8.2. “KENSOL Trading” Ltd. has the right, but not the obligation, to save materials and information located on the WWW.KENSOL.EU server.
8.3. “KENSOL Trading” Ltd has the right at any time, without notifying the user/client, when the latter uses the services in violation of these terms and conditions, as well as at the discretion of “KENSOL Trading” Ltd. to terminate, suspend or change the services provided in connection with the use on the site. “KENSOL Trading” Ltd. is not responsible towards users and third parties for damages suffered and lost benefits, which occurred because of the termination, suspension, change or limitation of services, deletion, modification, loss, unreliability, inaccuracy or incompleteness of messages, materials, or information, transmitted, used, recorded, or made available through WWW.KENSOL.EU.
“KENSOL Trading” Ltd., after receiving the payment, undertakes to deliver the goods requested for purchase on time, to check the quality of each item before it is sent (in case this is possible without violating the integrity of the packaging).
8.4 “KENSOL Trading” Ltd. is not responsible for damages caused to software, hardware or telecommunications facilities, or for loss of data resulting from materials or resources searched, loaded or used in any way through the services provided. The advice, consultations or assistance provided by the specialists and employees of “KENSOL Trading” Ltd. in connection with the use of the services by users does not give rise to any responsibility or obligations for “KENSOL Trading” Ltd.
8.5. “KENSOL Trading” Ltd. has the right to collect and use information relating to its Users/customers.
8.6. The information under the previous article can be used by “KENSOL Trading” Ltd., except in case of express disagreement of the User, sent to the specified e-mail address.
“KENSOL Trading” Ltd. collects and uses the information to improve the offered services.
All purposes for which “KENSOL Trading” Ltd. will use the information will be in accordance with international acts and good morals.
8.7. “KENSOL Trading” Ltd. is not responsible for failure to fulfill its obligations under this contract in the event of circumstances that “KENSOL Trading” Ltd. did not foresee and was not obliged to foresee – incl., cases of accidental events, problems in the global Internet network and in the provision of services beyond the control of “KENSOL Trading” Ltd.
8.8. “KENSOL Trading” Ltd. has the right to install cookies on users’ computers. Cookies are text files that are saved from the Internet page on the User’s hard drive and allow the recovery of information about the User, identifying him and allowing the tracking of his actions, the Internet pages he visits, the hyperlinks he uses, the information he uses and saves, and more.
IX. PERSONAL DATA
9.1. “KENSOL Trading” Ltd. guarantees its users/clients the confidentiality of the provided information and personal data. The latter will not be used, provided, or brought to the knowledge of third parties outside of the cases and under the conditions specified in these General Terms and Conditions.
“KENSOL Trading” Ltd. protects the personal data of the user/client, which became known to him when filling out the electronic form for making a purchase application, and this obligation is waived if the Client has provided incorrect data.
In compliance with the current legislation and the clauses of these General Terms and Conditions, “KENSOL Trading” Ltd. may use the Client’s personal data solely and exclusively for the purposes provided for in the contract. Any other purposes for which the data is used will be in accordance with Bulgarian legislation, applicable international acts, Internet ethics, rules of morality and good manners.
9.2. “KENSOL Trading” Ltd. undertakes not to disclose any personal data about the Client to third parties – state authorities, commercial companies, individuals, and others, except in cases where it has received the express written consent of the Client, the information is required by state authorities or official persons who, according to the current legislation, are authorized to request and collect such information.
“KENSOL Trading” Ltd. is obliged to provide the information under the law.
9.3. “KENSOL Trading” Ltd. is ready to delete the data of each registered user at his request by declaring it at the e-mail address: onlinestore@kensol.eu and his data from www.kensol.eu will be deleted.
X. CHANGES
The General Terms and Conditions may be changed at any time by “KENSOL Trading” Ltd., which has the right to change the characteristics of the services provided and the present General Terms and Conditions and based on changes in the legislation.
“KENSOL Trading” Ltd. undertakes to notify the User of the changes in the General Terms and Conditions by publishing a notice of the changes in a prominent place on its website and giving him sufficient time to familiarize himself with them. In the given period, if the User does not state that he rejects the changes, he is considered bound by them. If the User declares within the given period that he does not agree with the changes, “KENSOL Trading” Ltd. has the right to immediately suspend or terminate the provision of services to the User.
XI. TERMINOLOGY
11.1. “User/client” means anyone who has loaded the WWW.KENSOL.EU website on their computer.
11.2. “Order” means the selected goods and all other attributes related to the method of delivery and payment of the goods by the customer/user.
